Upon engaging our professional services of the three month Career Restoration Program, one on one career counselling sessions, one on one interview coaching, one on one job application coaching services, you, the Client, agree to accept our Terms and Conditions. Your access to and use of Career Mend is subject exclusively and strictly to our Terms and Conditions. By using this website, you agree to abide by the Terms and Conditions. If you do not agree to abide by these Terms and Conditions, you must immediately stop using our services.

We may choose not to accept your order for any reason. We reserve the right to withdraw any goods/services at any time. All prices are subject to change at any time prior to an order being placed and are subject to change without notice. We will not be liable to you or anyone else for refusing to accept your order, withdrawing any goods/services, or changing any prices. We retain the right to revoke your right to continued use of our services at our discretion.

In no event shall Career Mend be liable for any direct, indirect, incidental, consequential damages, or any damages whatsoever, including, without limitation, damages for loss of use, data, lost opportunities, arising out of or in any way connected with the use or performance of our services. Under no circumstances will Career Mend be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control, including without limitation, incorrect email addresses, internet failures, computer equipment failures, other equipment failures, or non-performance of third parties.

Career Mend will make every attempt to provide accurate and quality work. However, we do not guarantee any results/outcomes from our work in assisting our Clients in obtaining and/or finding employment. We do not guarantee any results/outcomes from our work in assisting our Clients to change career direction. We do not guarantee any results/outcomes from our work in curing symptoms of burnout or declined mental health resulting from negative workplace experiences. We do not guarantee interviews and successful results from interviews with the assistance of our interview skills coaching and all our other services provided.

LAW AND JURISDICTION

These Terms and Conditions are created in accordance with the governing law. Any disagreement relating to these terms and conditions will be subject completely to the jurisdiction of the courts.

ACKNOWLEDGEMENT

You, the Client, acknowledge that any document provided by Career Mend is based solely on information provided by you and that we cannot warrant the accuracy or truthfulness of your response. Career Mend services come from that of professionally trained career counsellors who are not expected to be industry experts. The work that is produced on your behalf is a result of the information that you provide, the tasks that are completed by you and the guidance of the career counsellor.

WARRANTIES AND LIABILITY

You, the Client, agree that Career Mend’s entire liability with respect to any service(s) provided under our Terms and Conditions and any breach of this, is solely limited to the amount you paid for such service(s). Career Mend shall not be liable for any direct, indirect, incidental, special or consequential damages resulting from the use or inability to use any of its services or for the cost of procurement of substitute services.

Career Mend will not be liable for the Client and the Client waives any right it has to claim, any loss of income, loss of profit, production, contract, customers, goodwill, opportunity or business, or any indirect, special or consequential loss or damage of any nature whatsoever arising under or in connection with writing services or interview skills coaching, or these Terms and Conditions, whether in contract, tort (including negligence), under statute, in equity or otherwise.

Career Mend offers service advice and suggestions only. Whilst we provide suggestions in good faith for your service, we cannot guarantee the suggestions provided will result in obtaining employment with any particular employer, being accepted into any particular academic institution or education, any increase relationship skills or any repairs to relationships within the workplace of the Client.

The Client accepts that the service is subjective to a certain degree, opinions vary and that we cannot guarantee any improvements to your job prospects. In no event will Career Mend be liable to you for any incidental, indirect, consequential or special damages of any kind, or any damages whatsoever arising out of or in connection with the use of our services, whether or not you have been advised or the possibility of such damages. Under no circumstances shall Career Mend be liable to you for any amount for services rendered pursuant to this agreement. To the maximum extent permitted by applicable law, you hereby release, and waive all claims against Career Mend and its employees and agents from any and all liability for claims, damages (actual and consequential), costs and expenses (including litigation costs and attorneys’ fees) of every kind and nature, arising out of or in any way connected with use of the Service.

VARIATION

While every effort is made to ensure that the content of this website is accurate, Career Mend may revise these Terms and Conditions from time-to-time. We reserve the right to change these Terms and Conditions at any time and without notice, and your continued use of our services following any change shall be deemed at your acceptance of such change. It is your responsibility to check the Terms and Conditions regularly for changes. Revised versions will apply to the use of this website from the date of publication of the revised Terms and Conditions on this website. Career Mend makes no representations or warranties in relation to the accuracy or completeness of the information found on it. We do not warrant that the servers that make this website available will be error, virus or bug-free and you accept that it is your responsibility to make adequate provision for protection against such threats. We recommend scanning any files before downloading.

INDEMNITY

You, the Client agree to indemnify Career Mend against any third party claim arising from or in any way related to your use of the service, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, and any other legal expenses.

You, the Client acknowledge and agree that Career Mend will retain ownership of all Intellectual Property created as a result of or in connection with the career counselling MEND program, career counselling services, interview skills coaching services, job application coaching services, resume writing, cover letter writing or linkedin writing services and other services associated with the company which produce intellectual property.

REFUND AND CANCELLATION POLICY

We do not issue refunds at Career Mend. Please note, if you change your mind after paying for our service, prior to your first consultation, there will be a minimum $100 cancellation fee. Refunds cannot occur after your first appointment. Career Mend services of any kind will not continue until the cancellation fee is paid. Sickness, work, emergencies, and unexpected events will still incur the scheduled cancellation fee. Rescheduling appointments must be completed by the Client 48 hours before. After that time, the Client will be charged the full session price for the missed session.

Upon receipt of your final documents, the Client will be given up to 7 days to make changes/reviews that are within reason. This is the opportunity to make accurate changes to ensure satisfaction. Career Mend determines the scope of reasonable modifications. If after the 7-day period you require further changes, charges will apply.

INTERNATIONAL WOMEN’S DAY SALE - 20% OFF

This sale will run from 25th February 2024 - March 30th 2024. Offer is only valid for new appointments delivered in this period - not the organisation or intention of booking. The delivery of the appointment must occur before March 30th 2024 to be eligible for the discount. The discount cannot be used on any appointments booked prior to 25th February 2024, including any customer that has booked a Career Restoration Program and started the first appointment of the program (the Assessment Call) prior to 25th February 2024. Offer can be used more than once when booked and delivered within the sale period. Any appointments or programs that are booked and delivered beyond March 30th will not be eligible - except those that book a Career Restoration Program and conduct their first appointment before 30th March 2024.

INFORMATION PROVIDED BY YOU

Any personal information you may provide to Career Mend is protected by the Privacy Policy associated with this site. You agree not to provide any information or materials to Career Mend that is defamatory, threatening, obscene, harassing, or otherwise unlawful, or that incorporates the proprietary material of another. Career Mend are not liable for any injury or damage caused by omissions, false statements, or other inaccuracies.

PRIVACY POLICY

In order to proceed with services with Career Mend, we require information from you in order to provide the best service possible. All correspondence may also be collected and stored, particularly in regard to sales, support and accounts, including email. Any information collected by us is collected via correspondence from you. This may be via the telephone, Email, mail, or directly through our website. Any details collected from Career Mend Clients are required in order to provide you with our products and/or services, and a high level of customer service.

The security of your personal information is important to us. We will never disclose your personal details to a third party except the necessary information required by providers of products or services you have purchased or to protect the rights, property or safety of www.careermend.com.au and www.careerment.au, our customers or third parties or if required by law. We never permanently store your financial details.

We use generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it.

Career Mend may, at its discretion, use other third parties to provide essential services on our site or for our business processes. We may share your details as necessary for the third party to provide that service. These third parties are prohibited from using your personally identifiable information for any other purpose. Career Mend does not share any information with third parties for any unknown or unrelated uses.

We reserve the right to disclose your personal identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process served on our website.

We reserve the right to modify this privacy statement at any time, so please review it frequently.

PAYMENT

Any products or services ordered from Career Mend will only be commenced once receipt of payment has been received and all appropriate information and material has been received from the client.

Payment can be made by Direct Deposit or payment plan via our third party payment platforms, Stripe and Paypal. Proof of purchase must be provided for your order to proceed.

All prices quoted on the Career Mend website are in Australian dollars, and all transactions are conducted in Australian dollars. GST is included in the prices quoted on the website.
